According to information outlined in the arrest warrant, Eatherly allegedly pulled his firearm before the physical confrontation took place. Court documents reportedly state he assumed a “bladed stance” and moved for the weapon prior to the altercation escalating.
Several witnesses also told 931Cville Media & News Company they observed the firearm being pulled before any physical contact occurred.
The information currently being discussed publicly has led some to argue Joshua Fox reacted in self-defense after seeing the weapon come out.
As the investigation remains ongoing, all allegations and evidence will continue to be reviewed through the court process.
